88Software USER AGREEMENT

This agreement contains the necessary rules for you to benefit from the services on our site. As a member of our site, you have read and agree to its terms and conditions.

1. The Parties

This 88Software User Agreement (hereinafter referred to as the 'User Agreement'), together with the documents referred to in it, which form an integral part of it, is concluded between 88Software and the User who is a member of the Site. It takes effect electronically when the User completes registration on the Site. All 88Software users are deemed to have accepted this User Agreement. As a member of our Site, you have read and agree to its terms and conditions.

2. Definitions

88Software provides macro software for certain computer games. In this agreement, 88Software programs are referred to as the "program", Valorant and other games as "games", and www.88software.com as the "site". Any natural or legal person who is a member of the Site and uses the services offered on the Site under the terms of this agreement is referred to as the "user".

3. Subject and Scope of the Contract

The subject of this User Agreement is to set out the services offered on the Site, the terms for using these Services, and the rights and obligations of the parties. The scope of the User Agreement includes this agreement, its annexes, and all warnings, notices and statements made by 88Software regarding the use of the Site, membership and the Services. By accepting the terms of the User Agreement, the User also accepts all statements made by 88Software regarding the use of the Site, membership and the Services, and accepts, declares and undertakes to act in accordance with them.

4. Membership and Terms of Service

a) Membership is completed when the user fills in the information requested in the relevant section of the Site and 88Software approves the registration. Until the membership process is completed, the user does not acquire the rights and authority of a User under this agreement.

b) To become a member of the Site, you must not be a minor (you must have reached the age of majority in your country of residence), and you must not have been temporarily suspended or banned from membership by 88Software under Article 5.2 of this Agreement. Registrations made by minors, or by persons who have been temporarily suspended or banned by 88Software under Article 5.2, do not create a membership of the Site, even if the registration process has been completed.

5. Rights and Obligations

5.1. Rights and Obligations of the User

a) The User accepts, declares and undertakes to comply with all terms of this User Agreement, the rules specified in the relevant parts of the Site and all applicable legislation when carrying out membership procedures and using the Services, and that they have read, understood and approved all of these terms and rules.

b) The User accepts, declares and undertakes that 88Software may disclose the User's confidential, private or commercial information to official authorities and to rights holders where required by applicable mandatory legislation or in cases of alleged infringement of the rights of other Users or third parties, and that no compensation can be claimed from 88Software for this under any circumstances.

c) Users are solely responsible for the security and safekeeping of the means they use to access the system (username, password, etc.) to use the Services offered by 88Software, and for keeping them away from third parties. 88Software has no direct or indirect responsibility for any damages suffered by Users and/or third parties due to the Users' negligence or faults regarding the security, safekeeping and use of these access means.

d) Users accept, declare and undertake that the information and content they provide on the Site is correct and lawful. 88Software is not obliged to check whether the information and content provided, uploaded or changed by Users is accurate, secure and lawful, and is not liable in any way for damages arising from incorrect or unlawful content.

e) Users may not transfer their rights and obligations under the User Agreement to any third party, in whole or in part, without the prior written consent of 88Software.

f) Users may use the Services offered by 88Software and carry out transactions on the Site only for lawful purposes. Users bear full legal and criminal responsibility for all of their transactions and actions on the Site. Users will not reproduce, copy, distribute or process the images, texts, visual and audio materials, video clips, files, databases and catalogs available on the Site in a way that infringes the rights or property of 88Software and/or third parties, and will not compete with 88Software, directly or indirectly, through these or any other actions. 88Software is not liable, directly or indirectly, for any damages that third parties suffer or may suffer due to Users' activities on the Site that violate this User Agreement and/or the law. 88Software reserves all rights to take legal action, file complaints and seek recourse.

g) Subject to the terms of this agreement, the program is provided for your personal use only, under a non-exclusive, revocable and non-transferable license to use the services. The User agrees not to sublicense, rent, lend or otherwise transfer the Program or the Service. The User also agrees not to modify, adapt or reverse engineer the site content or the program, not to attempt to obtain the program's source code, and not to use the Program or the Service other than as permitted in this agreement. Such violations can be detected. Users who commit them are liable for any material or moral damages caused to the producers, publishers and directors of the program, who reserve the right to take any necessary action.

5.2. 88Software's Rights and Obligations

a) 88Software reserves the right to change the services and contents of the Site at any time. 88Software may use this right without prior notice.

b) 88Software is not responsible for typographical errors in the prices of the products on the Site.

c) Prices of the products on the 88Software site may change instantly. In this case, the price that applies to the user is the price shown on the site at the moment the user makes the payment or purchases the product to their account through the site.

d) 88Software reserves the right to edit or remove the products on the site. In such cases, users cannot claim the continuity of the services. 88Software has no responsibility, directly or indirectly, for any damages suffered by users as a result of such changes or removals. Any material and/or moral damages of the users are not covered.

e) 88Software reserves the right to deactivate or discontinue the program. In such cases, users cannot claim the continuity of the services. 88Software has no responsibility, directly or indirectly, for any damages suffered by users in such cases. Any material and/or moral damages of the users are not covered.

f) The producers, publishers and directors of the program are not liable for any material or moral damages that may arise during the installation and use of the program, and do not accept any responsibility for any losses within or outside the game that may result from programming errors. It cannot be guaranteed that the program will always work as expected. Program publishers are not responsible for any in-game gains or losses arising from this. Changes to the program or its logic may be made while it is in use; some of these may benefit some users and not others. In this case, users who benefit or do not benefit from the change cannot claim any rights. Updates to the games the program works with may affect how the program works; the program publishers are not responsible for these changes. Program publishers are not responsible for any in-game gains or losses arising from updates to the program.

g) Our programs are intended for use in offline games to train yourself and/or test the features of the game in question. In online games, using any game plug-in is strictly prohibited. Game publishers may suspend or close the accounts of users found to be using game add-ons. The producers, publishers and directors of the program do not accept any responsibility for any material or moral losses that may arise from this. In particular, do not use our programs in games like Valorant.

h) The program's publishers always try to keep the program available. However, the servers and programs may go offline due to technical problems, including problems with the companies that provide the network infrastructure. In such cases, users cannot claim the continuity of the services. Program publishers do not accept any responsibility for any errors caused by programming. Any material and/or moral damages of the users are not covered.

i) The site administration may delete a user's account at any time if it detects a violation of the law or the program rules. Having purchased services connected to the program does not change this. The services are then no longer available.

j) If a user exploits a bug in the software to gain an unfair advantage, that user's account may be closed. The account of the person who first discovers the vulnerability and reports it to the management through the proper channels will not be closed. If the vulnerability is serious (a non-functioning button is not a serious vulnerability), the person who reported it may be rewarded as the management sees fit.

k) Accounts that use the same or a similar username as a member of the site administration to mislead other users, in a way that may cause material or moral damage to the management or other persons, will be closed.

l) The producers, publishers and directors of the program are not liable for material and/or moral damages resulting from the use of this program and the website.

m) 88Software may provide support or forum services to users. These services are subject to rules. In the event of rule violations (including in our Telegram channel), the penalties set by the site administration will apply. Prohibited behavior includes:
- Real-life threats.
- Slang and vulgar language.
- Insulting or humiliating others.
- Swearing.
- Advertising.  
- Selling or buying accounts.
- Transferring or taking over accounts.
- Turning users against the management or claiming that the site management is taking sides.
- Hacking accounts.
- Sharing other players' personal information (Skype, email, chat, etc.).
- Sharing your own personal information (Skype, email, chat, etc.).
- Pretending to be an admin or impersonating the management.
- Flooding or writing meaningless characters.
- Racism, separatism, politics.
- Pornographic content.

n) 88Software may modify the user agreement. Users are notified of these changes when they log in to the site.

o) The user must correctly enter the information requested by the payment system when making a payment. Otherwise, 88Software is not responsible for any problems that may occur.

p) 88Software is not responsible for possible delays, delivery problems, incomplete deliveries, etc. in the balance top-up service on the site.

q) After using the program, the user may have problems accessing other sites; the user may not be able to access some websites in the same sector. Any user registered with 88Software or using the program is deemed to have accepted this situation.

r) The program may be detected as a virus by various security programs (antivirus programs, etc.) because of the code and plugins it contains. Any user registered with 88Software or using the program is deemed to have accepted this situation.

s) The program makes various changes on the user's computer. Any user registered with 88Software or using the program is deemed to have accepted this situation.

t) Users are responsible for ensuring the security of the game accounts they have purchased from the site. 88Software cannot be held responsible for any problems with account security. 88Software reserves the right to remove, edit or delete a game account or game account listing without explanation.

u) By using our services, users are deemed to have accepted the risks and consequences of the services they purchase. Any delays in the purchase of the Service, inadequate results or price differences caused by inaccurate or incomplete information provided by the user are the user's responsibility.

v) 88Software is not liable in any way if a game account purchased after payment cannot be delivered, is delivered incompletely, or has a problem.

6. Product Cancellation and Refund Policy

a) If a user adds balance using a credit or debit card and the program does not work on their computer, they may request a refund within 12 hours of the purchase.

b) Refunds are not available for users who added balance using other payment methods (e.g., cryptocurrency, gift cards, etc.).

7. Privacy Policy

a) 88Software does not sell, rent, or make available to third parties any personal data (such as your email address, date of birth, etc.) submitted by site visitors through the forms on the site. Only authorized site management can access personal information. Management may use this information for the following purposes: Sending you press releases or notifications by email, delivering services and/or programs you have purchased. Management uses statistical information (browser type, browser qualifications, geographic location, age, gender, etc.) to improve the website and to have more information about its consumers in general, without disclosing their identity. This information is not disclosed to third parties. As required by law, personal information may be made available to governmental authorities or legal authorities.

b) If you sign in to our programs, we store your username, password, country, IP address, computer motherboard number, processor number and mouse model in our database.

c) The content of the pages of this website is for your general information and use only. It is subject to change without notice.

d) This website uses Google Analytics and Cloudflare to monitor browsing preferences. If you do allow this to be used, some personal information may be stored by us.

e) Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

f) Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

g) This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the source code, design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

h) All trademarks reproduced in this website which are not the property of, or licensed to, the operator are acknowledged on the website.

i) Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.

j) From time to time this website may also include links to other websites. These links are provided for your convenience to provide further information. They do not signify that we endorse the website(s). We have no responsibility for the content of the linked website(s).

k) Your use of this website and any dispute arising out of such use of the website is subject to the laws of Kazakhstan.

8. Other Provisions

8.1. Intellectual Property Rights

a) All elements of the Site (including, but not limited to, the program, design, text, images, HTML code and other code) are copyrighted works of 88Software and are owned by 88Software or used by 88Software under license from third parties. Users may not resell, share, distribute, display, reproduce or create derivative works from 88Software information or copyrighted works, or allow anyone else to access or use 88Software's Services. Otherwise, they are liable for all damages suffered by 88Software, including claims by third parties such as licensors, and for all related costs, including but not limited to court costs and attorneys' fees.

b) 88Software reserves all rights, including all material and intellectual property rights, trade information and know-how, relating to 88Software information and copyrighted works.

8.2. Amendments to the Agreement

88Software may, at its sole discretion and unilaterally, modify this User Agreement at any time it deems appropriate by posting it on the Site. The amended provisions of this User Agreement shall become effective on the date they are announced; the remaining provisions shall remain in force, and shall continue to yield their terms and consequences. This User Agreement may not be amended by unilateral declarations of the User.

8.3. Force Majeure

88Software is not liable for late, incomplete or non-performance of any of its obligations under this User Agreement in any case that is legally considered force majeure. Such cases are not considered a delay, incomplete performance, non-performance or default by 88Software, and no compensation can be claimed from 88Software for them. 'Force majeure' means any event that is beyond the reasonable control of the party concerned and cannot be prevented with due diligence, including but not limited to natural disasters, rebellion, war, strikes, communication problems, infrastructure and internet failures, power outages and bad weather conditions.

8.4. Termination of the Agreement

This User Agreement remains in force as long as the User is a member of the Site. It is deemed terminated when the User's membership ends or is suspended temporarily or permanently. 88Software may terminate this Agreement unilaterally if Users violate this User Agreement and/or the rules on use, membership and Services on the Site, in particular in the following cases, and the User is liable for any damages suffered by 88Software as a result:
a) The User behaving in any way that damages the Site,
b) The User letting someone else use the membership account created for them,
c) The User's involvement in acts that infringe or threaten to infringe the rights of third parties.

9. Privacy Policy

Our privacy policy is included in this User Agreement (see section 7).

10. Service Agreement

Our Service Agreement is available in our User Agreement.

11. Service Conditions

Our Terms of Service are set out in our User Agreement.

12. Refund and Cancellation

Our refund and cancellation conditions are stated in our User Agreement.

13. Legal Note

88Software programs don't classify themselves as Valorant cheat or game cheat software; they don't interact with the game or modify any game data. They don't read, receive, intercept or bypass any game data in any way either. 88Software programs only send mouse movement inputs to the computer. 88Software programs can be used for Photoshop, Paint, precision calculations for game development and design, browser auto-clicking and more. We are not liable for what people use our software for, just as gun manufacturers are not liable for crimes committed with their guns. This holds as long as 88Software programs are pixel-based and don't read, receive, intercept, modify or bypass Valorant's or other games' data in any way. We don't infringe copyright in any way either, as we don't use images from Valorant or other games anywhere. In particular, do not use our programs in games like Valorant.
